On December 19, 2024, Ontario’s Working for Workers Six Act, 2024 (Bill 200) received Royal Assent, introducing significant changes to employment legislation in the province.
Key Amendments:
- Employment Standards Act, 2000 (ESA):
- Sick Leave Documentation: Employers are now prohibited from requiring a certificate from a qualified health practitioner as evidence for an employee’s entitlement to sick leave under the ESA.
- Increased Penalties: The maximum fine for individuals convicted of violating the ESA has doubled from $50,000 to $100,000.
- Occupational Health and Safety Act (OHSA):
- Telework Inclusion: The OHSA now explicitly applies to telework performed in or around a private residence, ensuring remote workers are covered under health and safety regulations.
- Virtual Harassment: The definition of workplace harassment has been expanded to include incidents occurring virtually through information and communications technology.
- Electronic Posting: Employers can now post health and safety policies and committee member information electronically, provided they are readily accessible to all employees.
- Workplace Safety and Insurance Act, 1997:
- Presumptive Coverage: Presumptive coverage for post-traumatic stress disorder has been extended to wildland firefighters and wildland fire investigators, acknowledging the unique risks faced by these professionals.
These amendments aim to modernize Ontario’s employment laws, reflecting the evolving nature of work and the importance of employee well-being.
